Terms of Use
Ketchup is a place for honest reviews between friends. To keep it that way, the same rules apply to everyone. By using the app you agree to them.
1. Who runs Ketchup
The Ketchup app and the ketchup-app.cz website are operated by Eliathos s.r.o., Korunní 2569/108, Vinohrady, 101 00 Prague 10, Czech Republic, Company ID 23402491, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 426513 (“we”). Contact: podpora@ketchup-app.cz.
2. Your account
- You must be at least 15 years old to use Ketchup.
- One account per person, and you must not pretend to be someone else. A nickname is fine.
- You are responsible for what happens on your account. Don’t share your login details, and let us know if you suspect misuse.
- You can delete your account at any time in the app or by following the Delete your account page.
3. The service
Ketchup is free. We keep improving it, so features may change, be added or be removed. We work hard to keep the app reliable, but we can’t promise it will always be available or free of errors.
4. Your content
The reviews, texts and photos you add to Ketchup remain yours. So that we can show them to you and the people you share them with, you grant us a free, non-exclusive licence to store them, adapt them for display (for example resize a photo) and display them within Ketchup. The licence ends when you delete the content or your account. We won’t use your content outside Ketchup without your permission.
Only post content you have the rights to, typically your own photos and your own experiences.
5. Community guidelines
There is no place in Ketchup for:
- reviews of places you haven’t visited, reviews in exchange for a reward or on request, or reviews of your own or a competitor’s business,
- insults, threats, harassment or hate towards anyone for who they are,
- publishing other people’s personal data without their consent, including photos where they can be clearly recognised,
- false statements of fact that may harm someone. An opinion about food or service is fine, made-up facts are not,
- sexual or violent content, content endangering children and anything else illegal,
- spam, advertising and promotion without our consent,
- circumventing security, automated scraping and any other misuse of the app.
6. Reporting content and blocking
If you come across content that breaks these rules or the law, report it in the app using Report on a visit, comment or profile. You can block any user you don’t want to deal with; they then won’t see your content and you won’t see theirs.
You can also report content by email to podpora@ketchup-app.cz, even if you don’t use Ketchup. Tell us what the content is and where it is, why you believe it is illegal or against the rules, your name and email, and that you are reporting in good faith.
We usually handle reports within 24 hours. We remove content that breaks the rules and may restrict or close accounts for repeated or serious violations. We tell both the author and the person who reported the content what we decided and why. You can disagree with our decision by email to the same address within 6 months and we’ll review it again.
7. For restaurant and venue owners
Reviews in Ketchup are users’ personal opinions, which we neither verify nor edit. If you own a business and believe a review is false or illegal, write to podpora@ketchup-app.cz. We don’t accept payment for removing or changing reviews.
8. Ending your use
You can stop using Ketchup and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms or the law. If we ever shut Ketchup down entirely, we’ll let you know at least 30 days in advance so you can download your data.
9. Liability
Users are responsible for the content they post. We aren’t responsible for the quality of the places in Ketchup; they are simply rated by people. Nor are we liable for damage caused by an outage or error in the app, except for damage caused intentionally or through gross negligence and where liability can’t be excluded by law. Your statutory consumer rights are not affected.
10. App Store and Google Play
These terms are an agreement between you and us, not Apple or Google, and we are responsible for Ketchup and its content. If you downloaded the app from the App Store, Apple’s standard Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, the Google Play Terms of Service also apply.
11. Point of contact
The single point of contact for users and for EU Member State authorities and the European Commission (under Articles 11 and 12 of the Digital Services Act) is podpora@ketchup-app.cz. We communicate in Czech and English.
12. Governing law and disputes
These terms are governed by Czech law. If you are a consumer living in another EU country, you keep the protection your own country’s law gives you. The Czech Trade Inspection Authority handles out-of-court consumer disputes, coi.gov.cz/informace-o-adr.
13. Changes to these terms
We may change these terms, for example when we add a feature or the law changes. We’ll tell you about significant changes in the app or by email at least 14 days in advance. If you don’t agree with a change, you can delete your account.
This English version is a translation. If it differs from the Czech version, the Czech version prevails.
